Tracking Down Abandoned Assets in California – Part 1 of 2

The California’s unclaimed money program takes in approximately three hundred million dollars every year. What’s it to you? Well, if you or anyone you know is or ever was a resident of the Golden State (or ever had any type of business dealings, whether you knew it or not), a chunk of that massive pile of Cali forgotten funds might easily be yours!

Under the California unclaimed property (or escheat) law, lost money such as forgotten checking and savings accounts, uncashed checks and money orders, mineral deposits, salary checks, cash and stock dividends, state of California unclaimed tax refunds, gift certificates, and other financial assets are turned over to the Treasury Department if the rightful owners don’t locate them within a certain time period. This ‘dormancy period’ varies from state to state, but in Cali it is three years. These forgotten funds then head to the California unclaimed property division, where they stay in the state’s general fund until returned to the people they truly belong to. This is where state employees who handled Cali unclaimed cash were recently criticized. Seems that they have been all to happy to track down and take hold of the lost funds from the various establishments holding them but but were less than enthusiastic about contacting the actual owners in the Cali unclaimed funds database.

The total dollar amount for these funds in California averages five billion dollars annually – just imagine the amount of interest that earns for the state! Bill Palmer, an attorney in Sacramento who has fought in a number of cases involving CA unclaimed money, has said that the state’s program was supposed to be a lost and found of sorts for Californians. Instead, it has been turned into a profit earning ‘business’ in recent years.

The ban on the taking of property by California has since been removed and the new California State Controller, John Chiang, is making greater efforts in the form of widespread reforms in improving how his office deals with California unclaimed property. There is still a great need though for Californians and Americans in all states across the U.S. to be informed about the presence of these monies and on how to perform a thorough search for them.

The state of California’s unclaimed property program takes in approximately $300 million every year. Why should you care? Well, if you or someone you know is or was a resident of the Golden State (or had any kind of business dealings, whether you knew it or not), some of that massive pile of California lost assets could easily be yours!

Under the CA unclaimed property (or escheat) law, abandoned assets such as forgotten savings and checking accounts, cash and stock dividends, mineral deposits, uncashed checks and money orders, state of California unclaimed tax refunds, salary checks, gift certificates, and other assets are handed over to the Treasury Department if the rightful owners don’t come for them within a given time period. This ‘dormancy period’ varies from state to state, but in California it is 3 years. These lost assets then head to the CA unclaimed property div, where they wait in the state’s general fund until returned to their rightful owners. This is where state officials in-charge of the California unclaimed cash were recently criticized. They are all owed checks for forgotten funds by California amounting from hundreds to the thousands as in the case of Angelina Jolie. This just shows California state employees’ interest in keeping this cash in the general fund for use in balancing the budget deficits for as long as they possibly can. As a matter of fact, there was a recent ruling by a judge on CA abandoned cash, stating that the state was not making enough of an effort to locate the rightful owners and for a while halted the ability of the state to seize it until a proper method of reuniting it with the rightful owners has been adopted.

One of the main reasons for the government’s inability give back forgotten money to the people it belongs to, according to the government, is the fact that they can not be located. The issue is, who would think people like Angelina Jolie, ZsaZsa Gabor, Gerri Halliwell, Victoria Beckham, Keanu Reeves, Brad Pitt, Adam Sandler, Marlon Brando and Jennifer Lopez would be hard to find? Those names and the names of a number of other celebrities are just a few of the names in the CA missing money list but they haven’t heard from the employees at the California Unclaimed Property Division. They are all owed checks for forgotten funds by CA ranging in amount from hundreds to the thousands in Ms. Jolie’s case. This just proves CA state employees’ interest in holding this money in the general fund for them to balance the budget deficits for as long as they can. As a matter of fact, there was a recent ruling by a federal judge on CA abandoned cash, saying that the state was not doing enough to locate the rightful owners and has temporarily halted the state’s s ability to seize it until a new policy of returning it to the rightful owners was enacted.
